The history of tourism through the prism of the imperfection of the legislative base of tourism

Abstract

Introduction. The state structure of tourism management in Ukraine has undergone significant changes in the last 30 years. In the world literature, it is customary to distinguish three models of state tourism management: the activity of the tourism industry is controlled by a strong centralized ministry; management of the tourism industry is carried out in the system of multisectoral ministry; the absence of a central state tourist body. But it is also necessary to distinguish the model that existed in the period from April 1936 to December 1991, when Ukraine was part of the USSR. The state delegated the authority to develop tourism in the country of trade unions as part of the state apparatus of the ruling party, which performs specific functions. The aim of the research. The purpose of the work is to study the path of becoming a state-owned tourism department in Ukraine and identifying deficiencies in the articles of the Law of Ukraine «On Tourism». Materials and methods. During the work, materials concerning the development of state tourism administration in independent Ukraine were investigated. The analysis of the Law of Ukraine «On Tourism» and the Law of Ukraine on Amendments to the Law of Ukraine «On Tourism» was carried out. Results. During the independence of Ukraine, the model of state tourism administration has changed many times. Such a variety of forms of structures (agency, administration, department, committee, ministry, service) of the system of public administration, when at least 7 heads of the industry, not to mention the change of the apparatus itself, could not have a positive effect on the development of tourism in the country. Ukraine was the first country in the CIS, which adopted the Law on Tourism, but the speed of its adoption did not allow it to work thoroughly, so it is imperfect and needs some changes. Conclusions. For the sustainable development of tourism in Ukraine, it is first and foremost necessary to determine clearly with the state structure of management of the tourism industry, also to develop the Tourist Code of Ukraine, attracting the scientific potential of higher education institutions that prepare tourist personnel, as well as specialists of the tourism industry with extensive practical experience in tourism
